No Purchase or Transaction Necessary to Participate
Eligibility: This Sweepstakes is only offered in Pennsylvania and New Jersey and entrants must be legal residents of the U.S., 18 years of age or older, except employees, officers and directors of Firstrust Bank (“Sponsor”), its subsidiaries, affiliates, distributors, advertising and promotion agencies and their immediate family members (defined as spouses, children, parents, siblings, in-laws) and those living in their households Void where prohibited or restricted by law.
To Enter: The Sweepstakes begins on May 4, 2008 and ends at 11:59:59 p.m. (ET)on May 31, 2008 ("Promotional Period"). There are two (2) ways to enter during the Promotional Period: (1) Automatic Entry: Each eligible Firstrust Bank Certificate of Deposit purchase (CDs, excluding IRA CDs, with a term of 5-months at 3.25% APY, 11 months at 3.50% APY, 19 months at 3.65% APY or 5 years at 3.75% APY, with a $2,500 minimum deposit of new funds – funds that are not currently on deposit at Firstrust Bank or through Firstrust Financial Resources) automatically receives 1 entry during the Promotional Period. Such entry will be deemed to have been submitted by the primary accountholder (based on TIN). (2) To enter without purchase or obligation by mail: print name, address, day and evening phone numbers and email address on a 3" x 5" card, and mail to: Firstrust Bank, 15 East Ridge Pike, Conshohocken, PA 19428, ATTN: Marketing. All entries must be postmarked by May 31, 2008. Enter as often as you wish; limit 1 entry per stamped envelope. No mechanical reproductions or other automated means of entry permitted. All entries become the property of Sponsor and will not be returned.
Drawing: One random drawing from all eligible entries for an LG 50” High Definition Plasma Flat Screen TV (“TV”)will occur at Firstrust Bank Headquarters at 15 E. Ridge Pike, Conshohocken, PA 19428 on June 6, 2008. There will be no cash award in lieu of or in addition to the prize. The prizewinner will be notified by telephone, e-mail, certified mail (return receipt requested) or Federal Express by June 9, 2008. Prize may be claimed at Bob & Ron’s World Wide Stereo at 754 Rt. 309 Montgomeryville, PA 18936 or 44 Greenfield Avenue, Ardmore, PA 19003. Prizewinner may arrange for delivery and setup of the TV when the prize is claimed. Prizewinner is responsible for any cost of delivery, setup and other incidental fees or expenses pertaining to the prize. Federal, state and local income taxes are the sole responsibility of the prizewinner. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. By entering, entrants agree that Sponsor may contact entrants to encourage the purchase of Sponsor’s products and services. By entering, entrants agree that Firstrust Bank, its affiliates and subsidiaries shall have the right and permission to use winner’s name, picture, likeness and/or voice to any media for trade, advertising, promotional and/or any other purpose in any media now or hereafter known without further consideration except where prohibited by law. Firstrust Bank reserves the right to require the prizewinner to sign and return an affidavit of eligibility and liability release within 10 days of issuance of notification. Non-compliance will result in disqualification and an alternate winner being selected. Should the prize winner not claim their prize within 7 days from date of notification, an alternate winner may be selected at Sponsor’s option. Prizes are not refundable, not transferable, not assignable, and no substitutions may be made without written consent of the Sponsor. Odds of winning will be determined by the number of entries received.
7. Limitation of Liability: By participating in the Sweepstakes, entrants, agree to these Official Rules and to release, indemnify, and hold harmless Sponsor, its subsidiaries, affiliates, distributors and advertising and promotion agencies, suppliers and judges and all of their respective officers, directors, employees, representatives and agents from and against any injuries, losses, damages, claims, and actions, and any liability of any kind resulting, in whole or in part, directly or indirectly, from or arising from participation in the Sweepstakes or acceptance, possession, use, misuse, or nonuse of any prize that may be awarded. Entrants agree that the laws of the Commonwealth of Pennsylvania will govern any and all disputes. Sponsor is not responsible for technical, computer, mechanical, printing, typographical, human or other errors relating to or in connection with the Sweepstakes, including, without limitation, errors which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prize, or in any Sweepstakes-related materials; for stolen, lost, late, misdirected, damaged, incomplete, inaccurate, undelivered, delayed or illegible entries or postage-due entries or mail; or for electronic, computer, or telephonic malfunction or error. If in the Sponsor's opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Sweepstakes, the judges reserve the right at their sole discretion to disqualify any individual who tampers with the entry process and/or void any entries submitted fraudulently; to modify or suspend the Sweepstakes; or to terminate the Sweepstakes and, at Sponsor’s discretion, conduct a random drawing to award the prize using all eligible, non-suspect entries received as of the termination date. As a condition of entering the Sweepstakes, participant, agrees that: a.) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; b.) all causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action; and c.) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, and in no event shall participant be entitled to receive attorneys’ fees or other legal costs. Sponsor reserves the right to revise or withdraw this Sweepstakes or Official Rules at any time.
